Probation For Driver In Doane College Student Death

Wilber, NE - A judge sentenced a driver for the death of a friend who fell out of the back of his pickup.

22-year-old Cody Barnes was sentenced to one year probation. He was originally charged with felony manslaughter, but pleaded no contest to misdemeanor vehicular homicide.

Barnes' friend Cody Fanning and five  other students were riding in the truck bed on April 25th in Crete when Barnes turned. Fanning fell out and hit his head on the street. The popular 20-year-old football player died later at a hospital.

Police said drinking may have been involved. The students were headed back to campus from a fraternity bonfire. The next day was "Stop Day" on campus, a school tradition.

Saline County Attorney Tad Eickman said Barnes had stopped the truck before the accident and told Fanning to sit down. Fanning reportedly was standing just before he fell.
