Lawyers for a woman charged in connection with the murders of a mother and her young son are trying to get some of the evidence thrown out.

Gabriela Guevara, who is charged with five counts of accessory to a felony in the deaths of Ismenia Marinero and her 4-year-old son Josue, was in court Thursday.

Her lawyers are asking a judge to throw out statements she gave police when she was questioned.

Prosecutors say she helped her boyfriend, Roberto Martinez Marinero, after he killed his mother and half-brother.

Guevara’s lawyers say the testimony she gave officers was not voluntary and she didn’t understand her Miranda rights because she relies on a Spanish translator.

She claims she was physically abused by Roberto Martinez Marinero, and feared for the safety of her children while with him.

The hearing was still underway at midday.  Watch KMTV Action 3 News and check kmtv.com for updates.
