Two million dollars, that’s the bond for an illegal immigrant accused of hitting and killing a man while drunk.

34-year-old Margarito Nava-Luna's family never imagined Saturday night would be the last time they saw him alive.

“He gave me a hug and he said I love you,” said Nava-Luna’s stepson, Manuel Medina.

Prosecutors say Nava-Luna was out drinking with 27-year-old Orling Carrasco-Zelaya.  The pair was last seen playing pool at Bogies Bar around 2 a.m.

“Margarito saw him as his friend and it's just not fair,” said Nava Luna’s wife, Veronica Reyes.

Investigators say around 2:30 a.m. Carrasco-Zelaya was driving near Manderson Plaza and 104th Avenue when he crossed the center lane, hitting and killing Nava-Luna who had been walking in the area.

“It was not a mistake, he was going for it, he didn't even brake, he didn't even stop,” said Medina.

Witnesses tell police that Carrasco-Zelaya kept driving after striking Nava-Luna.  Fifteen minutes later, deputies pulled him over and arrested him for his fourth DUI.  His blood alcohol level was three times over the legal limit.

Carrasco-Zelaya faces multiple felony charges including Motor Vehicle Homicide and Leaving the Scene of an Accident.

“Why did he do this? He knew he had a family and a little boy.  That’s what I can’t process in my mind,” said Nava-Luna’s brother Felix.

Nava-Luna leaves behind a wife, children and siblings.  His family feels his death could have been prevented.

“I mean we can't do anything about this, we want justice, we just really want justice,” said Medina.

Carrasco-Zelaya is in the country illegally and in 2012 Immigrations and Customs Enforcement issued a deportation order.  He continued to live in the US under multiple aliases.

Nava-Luna’s stepson hopes the same thing doesn't happen to another innocent family.

“Hopefully they (ICE) don't make the same mistake, because it's not fair what they did to all of us,” said Medina.
