2nd Officer Fired for Wagner Incident to be Reinstated
It's this surveillance video and what happened after that's made it a tough road for the Omaha Police Department.

Surveillance video from May 2011 shows police arresting Robert Wagner outside of Creighton University Medical Center.
Police were there to control a large group of people after a shooting, and officers say Wagner was causing a disturbance.
The rough arrest led to the firing of officers Jackie Dolinsky and Aaron Pennington.
"During the course of that lawful arrest the officers had to use force in order to effect that arrest and that that force was justified based on the circumstances known to them at the time."
In June an independent labor arbitrator ruled to reinstate officer Dolinsky. We learned today, they reinstated officer Pennington as well.
The Omaha Police Officer's Association says the department;s termination was politically motivated and OPD handled the whole incident inappropriately.
"That if you watch that video tape it's easy to assume what happened by watching that video tape, but to prove concretely based solely on that video tape it's inconclusive."
