
An outspoken Omaha Defense Attorney is now representing the Lexington teacher accused of running off with a 13-year-old boy. Kelsey Peterson is accused of kidnapping and felony child abuse and may even be facing federal charges for taking a student out of the state to allegedly have sex. But her attorney says the sex scandal may not be a scandal at all.
Attorney James Martin Davis says this case is not like other cases. Davis says, "she is not a predator and this young man by no means is a victim."
Davis is now representing Peterson. He describes the student, 13-year-old Fernando Rodriguez as a young gang member, who shaves. In fact, Davis plans to do some digging to find out if he's 13 like he says he is. Regardless, Peterson's attorney claims the boy is not a victim.
Davis says, "I think he was out there talking about this and Kelsey Peterson was a notch on his belt."
But prosecutor do not agree calling Rodriguez a victim of a sex crime and call Peterson a criminal for taking the boy across state lines for sex.
Davis says the teacher was obviously shaken as she talked to him from a California jail cell. He isn't saying she's innocent, just overcharged.
Davis says, "they're portraying her as some kind of monster and that's not the case."
The earliest Peterson is expected to be extradited back to Nebraska would be a week from now, but it could take as long as three weeks.
